France Enacts Right to Assisted Dying Law

France has crossed a historic threshold in its approach to end-of-life care. The law establishing a right to assisted dying was officially published in the Journal officiel on Wednesday, August 19, following its promulgation by President Emmanuel Macron. The move caps years of intense public and parliamentary debate on one of the nation’s most sensitive social issues.

The legislation, which received final approval from Parliament in mid-July and was validated with minor reservations by the Constitutional Council last week, creates a strictly regulated framework for certain patients to end their lives. Under the new law, eligible individuals may self-administer a lethal substance in the presence of a healthcare professional. Only in cases where the patient is physically incapable of performing the act themselves can a caregiver administer the substance on their behalf.

Strict Eligibility Criteria Define the New Right

Access to assisted dying is not open-ended. The law sets out several cumulative conditions that patients must meet to qualify. An eligible patient must be an adult, either a French citizen or a long-term resident, and be suffering from a “serious and incurable” condition that is either in a terminal or “advanced” phase. Furthermore, the patient must be experiencing unbearable physical suffering and must retain the capacity to express an informed and lucid choice up until the final moment.

The determination of eligibility is not a simple process. It involves a procedure led by a single physician, but that physician is required to consult with other healthcare actors before a final decision is made. This multi-step process is designed to ensure that the profound decision to pursue assisted dying is made with thorough medical and ethical consideration.

Implementation Awaits Government Decrees

While the law is now officially on the books, its practical application is not yet immediate. Before healthcare professionals can begin implementing the new provisions, the government must publish the necessary application decrees. These decrees will outline the specific operational details and procedures required to put the law into practice across the French healthcare system.

With this landmark legislation, France joins a relatively small group of countries that have legalized some form of assisted dying. This group includes Belgium, Switzerland, the Netherlands, Canada, and Uruguay, each with its own distinct regulatory approach. The French model, with its emphasis on self-administration and rigorous eligibility checks, represents a carefully calibrated balance between individual autonomy and societal safeguards.
