Islamabad Seeks Swift Review of Imran Khan Hospital Order

The Chief Commissioner of Islamabad has formally requested the Supreme Court of Pakistan to expedite a hearing on the government’s review petition challenging the court’s August 18 order. That directive had mandated the transfer of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan from Adiala Jail to a private hospital for medical evaluation and treatment.

The application, filed on behalf of the federal capital’s administration, argues that the matter extends far beyond access to healthcare facilities. It raises what the petitioner describes as significant legal and constitutional questions regarding judicial jurisdiction, particularly in light of the 27th Constitutional Amendment, Article 175(2), and existing prison laws.

Constitutional Jurisdiction at the Heart of the Dispute

According to the petition, the Supreme Court’s earlier ruling was issued under pressing time constraints, making an urgent rehearing essential. The government is seeking a review, modification, and ultimately the withdrawal of the August 18 order that directed the medical panel to examine Khan outside the prison system.

The petitioner contends that the court’s intervention may have overstepped legal boundaries established by recent constitutional changes and statutory frameworks governing incarcerated individuals. The review petition specifically challenges the judicial authority to order such a transfer under the current legal structure.

Government Maintains Compliance with Court Directive

Federal Minister for Information and Broadcasting Atta Tarar earlier stated that all requirements set forth in the Supreme Court’s order were fully met during Imran Khan’s medical examination. Speaking to media in Islamabad, Tarar emphasized that health-related matters should remain free from political exploitation.

“The government has not adopted any derogatory attitude toward Imran Khan following the court’s order,” Tarar said, reiterating that healthcare concerns must be kept separate from political discourse. He stressed this position has been consistent both in the past and present.

Legal Questions Beyond Medical Treatment

The Islamabad administration’s petition underscores that the core issue is not merely about providing medical facilities to a prisoner. Instead, it frames the dispute as a fundamental test of judicial jurisdiction following constitutional amendments and the application of prison regulations.

The Chief Commissioner has urged the Supreme Court to schedule the review petition for hearing at the earliest possible date, arguing that the legal principles at stake demand swift judicial clarification. The outcome could set significant precedent for how courts interact with executive authority over incarcerated individuals.
