Pakistan FCC Chief Justice Stresses Constitutional Supremacy

ISLAMABAD — The Chief Justice of Pakistan’s Federal Constitutional Court, Aminuddin Khan, has declared that the Constitution must take precedence whenever governmental powers are exercised, positioning constitutional fidelity as the cornerstone of national stability.

Constitution as Anchor of Stability

Speaking at the opening ceremony of the 2026-27 judicial year at the Federal Constitutional Court, Justice Khan said the occasion offered an opportunity to renew the institution’s commitment to delivering justice. He emphasized that the Constitution clearly delineates the scope and limits of authority, and that respecting those boundaries is indispensable for maintaining order in society.

“Whenever powers are exercised, the Constitution must remain paramount,” he said, adding that adherence to constitutional principles is essential for ensuring stability.

Court’s Performance and Technological Push

The chief justice noted that the Federal Constitutional Court has been effectively discharging its responsibilities in constitutional matters and has delivered rulings in several significant cases within a short span of time. He underscored the importance of embracing modern technology in judicial affairs, saying it can strengthen institutional capacity and enhance transparency.

  • The court has resolved multiple high-profile constitutional cases in a compressed timeframe.
  • Technology adoption is viewed as a tool to improve institutional efficiency.
  • Transparency remains a key objective for the court’s operations.

Access to Justice as a Fundamental Right

Justice Khan further stated that access to justice is a fundamental right of every citizen, and that providing constitutional justice without discrimination should remain a core priority for the judiciary. He described the start of the new judicial year as a moment to reaffirm that commitment.

The remarks underscore the court’s dual focus: upholding constitutional supremacy while modernizing its processes to serve the public more effectively.
