The Lahore High Court has disposed of a petition seeking the recovery of the sisters of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan, after the Punjab government confirmed that their detention had been extended for a further 30 days.
Court Reviews Home Secretary’s Report
Justice Abhar Gul Khan heard the petition, which was filed by a petitioner named Shahraiz. During the proceedings, the Punjab government’s lawyer informed the court that the detention of Aleema Khan, Uzma Khan and Noreen Niazi had been extended for another 30 days on October 7. The court considered a report submitted by the home secretary before reaching its decision.
Petitioner Had Sought Recovery and Production
The petitioner’s counsel had asked the court to order the recovery of the three women and to direct authorities to produce them before the court. According to the petition, the three women had been detained by the deputy commissioner of Lahore for 30 days, and the petitioner maintained that the detention period had expired without their release.
Court Notes Procedural Gap in Petition
During the hearing, the court observed that the detention notification had been issued by the deputy commissioner, but the petitioner had not made the deputy commissioner a party to the case. Petitioner’s counsel Rana Mudassar Umar acknowledged the issue, stating that they were aware the 26th and 27th constitutional amendments would pose a hurdle in the matter.
The court remarked that the petitioner should have been aware of the legal requirements, adding that it could not issue an order beyond the scope of the petition. After reviewing the home secretary’s report and hearing the arguments, the court disposed of the petition.
